Registering for a personal account and/or subscribing to Colorhut emails:

You must be over 16 to register for a personal account, subscribe to Colorhut emails and/or place an order with Colorhut.

Some of the products that we sell may be considered more appropriate to adults and could be subject to age or other restrictions in some countries. You must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable or responsible if you break any such law. By placing an order with us, you are confirming that you are of the appropriate legal age to purchase the items. If we discover that you are not legally entitled to order certain products, we will not be obliged to complete the order.

To order products using the Website, we ask you to register for a personal account. Any personal data that you provide us with during the registration process will be stored in our database and may not need to be re-entered with each new order.

You will need to supply us via the online registration form with certain information including but might be not limited to: your email address, first name, surname, billing address and, where applicable, different delivery address. Once you click on the “Continue” button this information will be stored in our customer database. You can access, update or correct your personal account details via the “My Account” section of the Website. We will only use the stored data in accordance with our Privacy Policy.

You are responsible for maintaining the confidentiality of your password and email address and are responsible for all activities that are carried out under them. We do not have the means to check the identities of people using the Website and will not be responsible for losses suffered by you where your password or email address is used by someone else unless this is due to our negligence. ONLINE STORE TERMS


You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

A breach or violation of any of the Terms will result in an immediate termination of your Services and/or other legal proceedings against you should we consider it to be required.


GENERAL CONDITIONS


We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Colorhut will not accept any responsibility for the loss or damage (including clothing) to any personal belongings that you bring into the salon, Whilst we will always try to keep your belongings safe and damage free we cannot accept responsibility for any loss or damage to your personal belongings. We take precautions to protect your clothes from colour but we do advise that you avoid wearing expensive items of clothing whilst in the salon. Hair colour can get onto the salon chairs and floor and this can transfer onto your belongings.


PROFESSIONAL USE ONLY


Nothing contained in these Terms and conditions, any information on our Website, and/or any information provided via any third-party, should be construed as medical, commercial, legal or other professional advice. Detailed professional advice should be obtained before taking or refraining from any action based on any of the information contained in these Terms and conditions or any communications provided to you as a result of your use of our Service.

Not all products are suitable for all medical ailments and occasionally, their use may interfere with any treatment you are receiving and/or aggravate a condition. Please speak to your pharmacist, a medical professional, or any other applicable qualified professional if you are in any doubt before ordering.

All products are sold only on the understanding that they are to be used for the purpose intended by a qualified and insured person of adult age. This means Colorhut will accept no responsibility if the products are incorrectly used and cause any kind of harm or damage. You also acknowledge to be such a knowledgeable, qualified and insured person of adult age at the time of purchase. Therefore, Colorhut also reserves itself the right to refuse a customer if it has grounds to believe that they are not a qualified professional.


ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION


We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Prices for our products and/or services are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

On our website we keep a list of indicative prices for some of the most common services that we provide. While we make every effort to maintain consistency in our pricing, actual costs can vary depending on the specific requirements of each client and/or each appointment. The prices on our website are there only for reference and we cannot guarantee that these are the exact prices that you will be quoted or charged for your appointment. If you need a quote we would be happy to provide you with one. You may also request supplemental quotes for services added during your appointment.


PRODUCTS OR SERVICES


Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products, and descriptions of services that appear at our website. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Because of the costs involved in getting a specialist to the place of your appointment we may add a Travel Charge to your total bill. If such a charge is required, it’s usually included in the total final price quoted to you. However, if you wish, the travel charge can be quoted separately when you request a detailed estimate of your quote and/or invoice.


BOOKINGS


We may request a booking deposit to reserve the time of your appointment. The cost of the booking deposit will be deducted from the total bill of the appointment. This deposit may be refunded if you cancel your booking at least 48 hours before the starting time of your appointment. We can only accept cancellations via email or phone. If you fail to notify us of the cancellation at least 48 hours before the starting time of your appointment, we have the right to keep the booking deposit. We have a different booking policy for Bridal Services. Please refer to the appropriate section for more details.

Depending on the total value of your appointment, booking deposits and cancellation policies may be different for some services. We will make sure to notify you of any required deposits and their respective cancellation period when different than our standard terms.

If you are more than 15 minutes late we may have to ask you to re-schedule your appointment or offer an alternative service or day for your appointment.

Extra charges for long hair, extra services and time are at the discretion of your stylist. You will be informed of any extra charges before the stylist begins this service.

All clients that have not had a colour service before are strongly recommended to have a skin allergy patch test done 48hours before any colour appointment. We also recommend that existing customers have a patch test if they haven’t visited us for six months or more. Speak to any of our stylist and they will be happy to give you advice on this.


THE ORDERING PROCESS AND ORDER CONFIRMATION


Your order via our online purchase order form constitutes an offer to us to buy the products you select from the Website. All orders are subject to availability and to acceptance by us. We reserve the right to refuse to accept an order. All communications will be addressed to the email address you supply when you register.

You may select items from our range of products, details of which will be added to the “Shopping Cart” by clicking on the “Add to cart” button. Before placing an order you can view and amend your order details at any time by clicking on the “Shopping Cart”.

By clicking on “Pay by Card” (or equivalent button for other payment methods) at Checkout, you submit an offer to buy the goods in the Shopping Cart.

We accept payment through PayPal and any Credit/Debit card, or any other means we might find appropriate.

The available methods of payments are displayed on the Website at checkout. Payment will be debited from your account at the point you confirm your order.

You confirm that the payment credentials being used are yours. Your payment credentials will be subject to validation checks and authorisation by our payment processing provider.

Fraudulent payment credentials will be reported to the relevant authorities. If the issuer of your payment credentials refuses to authorise payment we will not accept your order and neither we nor any of our partners and/or associates will be responsible for any delay or non-delivery and we are not obliged to inform you of the reason for the refusal.

Once you have placed an order for goods (and delivery if applicable) you will receive a confirmation that your order has been received (see below).

You will automatically be sent an email confirming receipt of your order (the “Confirmation Email”) with a summary of the details of your order, which we recommend you print out and keep for your own records. The Confirmation Email does not constitute our acceptance of your order; it merely records the fact that Colorhut has received your order. Please check that all details in the Confirmation Email are correct. If not, or if you do not receive a Confirmation Email please contact our Customer Care Team.

Colorhut might send a second email when we dispatch your goods which shall constitute our acceptance of your order (the “Acceptance Email”) at which point a binding contract of sale for products will be concluded between you and us or between you and the Concession Brand as applicable.

We will retain a record of all orders accepted by us. You can find details about your recent orders by logging into your Account via the “My Account” link at the top left hand side of the Website.

The price of a product shall be as stated on this Website at the time you place your order except in the case of obvious error. We try and ensure that all prices on our Website are accurate but errors may occur. If we discover an error in the price of a product you have ordered, we will not be liable to supply that item to you at the stated price, provided that we notify you before we despatch the item to you. In those circumstances, we will inform you of the correct price as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you cancel no payment will be taken; or if payment has already been taken, it will be refunded.


RESALE OF A PRODUCT


You may not sell or resell any of the products or services, or any samples that you may receive from us.


DELIVERY AND OWNERSHIP


We accept orders for delivery to the majority of countries. Unless otherwise stated, delivery will be made from our warehouse to the address provided by you. For orders fulfilled by Colorhut we will endeavor to dispatch the product to you within one working day of you placing your order and in any event within 7 working days beginning on the day after you place your order.

If we are unable to dispatch the product within that time we will email to let you know and to give you an estimated delivery date. In these circumstances we will offer you the opportunity to cancel the order and receive a full refund.

For customers outside the European Union: please note that our delivery/shipping fees do not include customs fees or taxes. You may be charged customs duties or taxes depending on your local legislation. Such duties or taxes are to be paid by customer and are not included in our prices.

If you do not wish to use our shipping services, you can alternatively collect your goods from our warehouse in the UK by contacting us via info@colorhut.uk.

If for any reason you do not receive your delivery, please note that we will only consider claims for lost items sent:

30 days after the latest due date for UK orders

45 days after the latest due date for EU orders

60 days after the latest due date for International orders

Additionally, we will not accept liability for lost orders if you select for your parcel to be left in a safe place or with a neighbour.


CANCELLATION, RETURNS AND REFUNDS


You have a right to cancel your order within 14 days, beginning the day after the day on which you receive the product, and to receive a full refund, even if the product is not defective. This right is subject to certain conditions and exceptions.

If you are not completely satisfied with your purchase, contact us within 14 days to arrange a return.

Please note that due to the nature of the products, we cannot accept items that have already been opened and used.

Returned items should be unused and must be returned in original packaging with any enclosed documentation. We will either exchange the item or issue a full refund on receipt.

1 – Goods will only be accepted for return if they are dispatched within 14 days of delivery, unless we have notified you otherwise.

2 – The item is your responsibility until it reaches us. Therefore for your own protection we recommend that you send your return using a delivery service that insures you for the value of the goods.

3 – The cost of returning the item to us is your responsibility.

4 – Delivery charges are only refundable where goods are faulty and a refund is made.

Cancellation can be communicated by visiting relevant section on our website or contacting our Customer Care Team.

Please return the Product in unopened original packaging to ensure it reaches us in good condition.

Please ensure that you also return any free gifts that are associated with your return items or the related order. If the free gift isn’t returned, then we reserve the right to deduct the value of the free gift from your refund.

Please note that we do not accept returns of personalised products.

Please note that if you fail to take reasonable care of returned products, or fail to return the product to us, we will be entitled to make a claim against you for any losses which we suffer.

Please note that we reserve the right not to accept orders from customers with unusual or suspicious returns behaviour.


RETURN OF NON-FAULTY GOODS


We hope you will be happy with your purchase from us. If not, you have the right to return the product to us and receive a partial refund excluding delivery and any other costs incurred by us, providing:

you notify us in writing that you are canceling your purchase within 14 days, beginning the day after the day on which you receive the product;

you have taken reasonable care of the product prior to return – in particular this means they must not have been damaged. Items can only be returned for a refund if they are unopened, unused and in a re-saleable condition with all tamper-resistant seals, packaging and any cellophane intact. We recommend a photograph is taken of the item prior to returning it if you are concerned about damage during its return journey;


BOOKINGS REFUNDS OR CANCELLATIONS


If you wish to cancel your appointment please let us know as soon as possible. If you have paid a booking deposit it might be refunded as long as you haven’t exceeded the required cancellation period, subject to the icurred costs by us. Should you wish to reschedule we will do our best to accommodate your needs but we cannot guarantee a minimum waiting period as it depends on our other bookings.

If you are not satisfied with the service provided to you we will do our best to find a solution to get you the look you are after. If the unsatisfactory result can be attributed to the specialist, we will usually offer you a corrective session at a discounted price. Unfortunately, we cannot offer you a discounted corrective session if you changed your mind during or after your session.

Sometimes clients are not well-informed on what is feasible or, the possible outcome of a requested service which is why we will try to explain to you your realistic options prior to the session. If you decide not to follow our advice and wish to proceed with a service we do not recommend as suitable for your style/needs, we may ask you to provide a short declaration that removes the responsibility of the outcome from the specialist.


ACCURACY OF BILLING AND ACCOUNT INFORMATION


By accepting the Terms you confirm that all information and details provided by you to us (including on registration) are true, accurate and up to date in all respects and at all times.

You agree that in using the Website you will not: (i) use the Website in any way that causes, or is likely to cause the site or access to the site to be interrupted, damaged, or impaired in any way; (ii) use the Website for any purpose that could damage the name of Colorhut, our Partners, or any goodwill attached to the Website; (iii) use the Website for criminal, fraudulent or illegal activity or in any manner which would cause harm or distress to any third party; (iv) access or attempt to access the accounts of other users or attempt to penetrate the Website security measures; nor (v) use the Website for any purpose other than your personal use.

We reserve the right to suspend, restrict or terminate your access to the Website at any time without notice if we have reasonable grounds to believe that you have breached any of these restrictions or if we suspect fraudulent account activity or behavior. This shall not limit our right to take any other action against you that we consider appropriate.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SALE TERMS USING DISCOUNTS


From time to time we issue Promotion Codes, Discount Codes, or Coupons. We have a Promotion/Discount Code box situated at the “Checkout” page where codes can be entered. You must take care when entering codes as they are case and space sensitive. You may only redeem one code at a time so we advise you to choose the promotion best suited to your purchase.

Discount codes and/or Promotion codes can only be used one per transaction, unless we give express permission otherwise. We reserve the right to extend or discontinue any voucher code or discount to our website. No discount code shall be used on sale items or reduced priced goods.

Before booking your appointment it is extremely important and your responsibility to inform us if you have not been skin tested or had a permanent colour within the last six months. If not, it is your responsibility to visit us at least 48 hours prior to your appointment so that this can be done for you. It is also your responsibility to inform us if you have had any previous reactions from colouring in the past, whether it be from a home colour kit or in a salon. It is necessary to be honest about any previous incidents in order for us to do our best to protect you.

In no case shall Colorhut, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Colorhut accepts no responsibility for the damage to jewellery and/or clothing, or any other valuables, especially during perming, cutting or colouring. Every reasonable precaution is taken to protect clothing and jewellery with gowns, towels and paper towels. It is recommended that any jewellery and/or other valuables are removed.


INDEMNIFICATION


You agree to indemnify, defend and hold harmless Colorhut and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
